These terms and conditions shall apply to all purchase and sales agreements entered into by Merunisha Moonilal and its customers through the Merunisha Moonilal website. Ordering

All orders are subject to acceptance and availability. You can place an order with us by clicking on all desired items on the website, which will atomically place them in your Shopping Cart. You may then check your Shopping Cart and make any changes if necessary. Once you find the Shopping Cart corresponding with your requirements, you may click on the Check Out button, which will generate an electronic order. Upon completion of the order form, including details of shipping address, shipping methods and payment your order is completed. Once you have checked out and your order has been confirmed you will not be able to make any changes to your order so please make sure that everything is correct before clicking the confirm button.

We will take all care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website.  Upon processing your order, we will in principle send an e-mail acknowledging receipt. The sale and purchase agreement shall be completed upon sending said e-mail. Said agreement shall therefore be deemed to have been concluded in The Netherlands. We reserve the right however, to refuse to process a transaction for any reason and/or to refuse service to anyone at any time in its sole discretion.

Product Information

We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery.

All sizes and measurements are approximate; however we do make every effort to ensure they are as accurate as possible. Unless otherwise stated, sizes indicated are European and  UK sizes. Please refer to the size guide for clarification.

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. We reserve the right to refuse orders where product information has been mis-published, including prices and promotions.

Goods are subject to availability. As there is a delay between the time when the order is placed and the time when the order is accepted, the stock position relating to particular items may change. If an item you have ordered becomes out of stock before we accept the order we shall notify you as soon as possible and you will not be charged for the out of stock items if you choose to cancel the order.

All prices are inclusive of VAT at the current rates and are correct at the time of entering information. We reserve the right to change prices without prior notice to you. The total price listed on the Order List and on the electronic order form does include shipping costs. Any and all customs or import duties and/or local taxes shall be for the account of the customer. They are not included in the price. Changes in prices do not affect the sum payable in a concluded sale and purchase agreement as confirmed by Merunisha Moonilal by e-mail.

Payment

Payment can be made by means of Paypal (international), Ideal (only for The Netherlands) or direct bank transfer. Payment will be debited and cleared from your account at the time that your order is accepted by Merunisha Moonilal BV. You confirm that the credit/debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to Merunisha Moonilal BV, we will not be liable for any delay or non-delivery. We reserve the right to withdraw any merchandise from the website at any time and/or remove, screen or edit any materials or content on the website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of its withdrawing any merchandise from the website whether or not that merchandise has been sold; removing, screening or editing any materials or content on the website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

The purchase of merchandise is limited to parties that lawfully can enter into and form contracts on the website under Dutch law. To register, you must provide your real name, phone number, email address and other requested information. The website is available only to individuals and others who meet the terms of eligibility, who have been issued a valid credit card by a bank acceptable to Merunisha Moonilal, whose applications are acceptable to Merunisha Moonilal and who have authorised Merunisha Moonilal to process a charge or charges on their credit card in the amount of the total purchase price for the merchandise that they purchase. By making an offer to buy merchandise, you specifically authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to your credit card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.

Delivery

We only deliver to customers who have an address in the European Union. However, should you live outside the EU, we are willing to assist you in any way we can. Please send us an email with your request and destination.

Standard delivery time is within 5 working days following the date your payment is received. Express delivery time is within 3 working days, following the date of your payment received. There are extra courier charges for express delivery, depending on where you live. Final confirmation of these extra charges will be provided by email after you have placed an order.

We shall do our very best to deliver all purchases within the period indicated on the website.  We are however dependent of our suppliers in this respect. As a result, all times indicated on the website are indicative only. We shall not be liable in any way if delivery takes place at a later date. Exceeding the term of delivery and/or exceeding the term of thirty days upon placement of the order, shall not automatically place Merunisha Moonilal in default. Deliveries are made by postal services or courier. If they do not succeed in delivering your order at the first attempt, a message, indicating information about the unit where your order is being held, will be left for you. All items are insured by Merunisha Moonilal BV until such time that they have been delivered at your address. Any complaints regarding the state in which goods have been delivered (including missing tags) must be made to us no later than two working days upon receipt of the goods by e-mail or telephone at the address/number listed in paragraph 1.

Returns

All goods bought at Merunisha Moonilal can be returned free of charge after cancellation within seven working days upon delivery. Said cancellation must take place by means of sending an email to This e-mail address is being protected from spam bots, you need JavaScript enabled to view it with your reason for return and your order number upon which we shall provide you with a RSN (return service number). Cancellation shall automatically bring about the dissolution of the sale and purchase agreement between Merunisha Moonilal BV and the customer and obliges the customer to return the goods to Merunisha Moonilal within five days of cancellation. Returned goods must be identified by the purchasers by means of enclosing the RSN. Unidentified goods may be returned to the purchaser without refund. Returned goods must be shipped by UPS courier, using the pre-printed return form that is en-closed with the delivery, within five days of cancellation. All accurately returned products will be credited as a refund to the original purchaser. Please note that this is excluding the shipping costs to the shipping address. Merunisha Moonilal BV will only pay the costs of the return shipping. In order to receive a refund, the product you return must be in new, unused, and unworn condition with all the original packaging and garment tags still attached. New and unused means that there are no marks on the item or any wear on the tags.

Liability

Merunisha Moonilal’s liability towards the purchaser shall be limited to the amount of the purchase price. Merunisha Moonilal shall never be liable for any loss of profits or goodwill or any other consequential damages.

Applicable Law

All agreements are made in English. Merunisha Moonilal will be governed by and construed in accordance with the laws of The Netherlands, and you irrevocably submit to the exclusive jurisdiction of the courts of The Netherlands.
